Terms of Use for Safeterm: Web-Based MedDRA Search Tool

These Terms of Use govern your access to and use of Safeterm, a web-based MedDRA search and encoding tool owned and operated by ClinBAY Limited. By using Safeterm, you agree to comply with the following terms and conditions:

  1. LICENSE GRANT - ClinBAY Limited (ClinBAY) grants you a non-exclusive, non-transferable, limited license to access and use Safeterm via the web interface for the duration of your subscription or authorized access period, subject to compliance with these Terms of Use.
  2. SUBSCRIPTION ACCESS - Safeterm is available through a subscription-based access model. Upon activation of your subscription, you are granted access to the tool’s functionality, including its AI-assisted MedDRA search and encoding features.
  3. INDEPENDENT MEDDRA LICENSE REQUIRED - You must maintain a valid and current MedDRA license, obtained directly from the MedDRA Maintenance and Support Services Organization (MSSO). ClinBAY does not provide or facilitate MedDRA licensing.
  4. FEES - Access to Safeterm is currently free of charge for new registrations. ClinBAY reserves the right to introduce fees (e.g., subscription fees, usage-based fees) in the future, linked to enhanced support or premium subscription.
  5. USAGE RESTRICTIONS - You may not sublicense, redistribute, or allow third-party access to Safeterm. Reverse engineering, copying, or attempting to replicate any part of the system is strictly prohibited. Unauthorized access or use will result in immediate termination of access.
  6. INTELLECTUAL PROPERTY - All intellectual property rights in and to Safeterm, including its AI models, interface, and underlying technology, are and shall remain the exclusive property of ClinBAY Ltd. No rights are granted other than as expressly set forth in these terms.
  7. SUPPORT AND MAINTENANCE - ClinBAY Ltd provides standard technical support and routine maintenance updates as part of the current subscription. Enhanced support may be available under separate agreement.
  8. CONFIDENTIALITY - Any information exchanged between you and ClinBAY, including login credentials and usage data, must be treated as confidential and not disclosed to third parties without express written consent.
  9. DISCLAIMER OF LIABILITY FOR OUTPUT - ClinBAY disclaims any liability for the accuracy, completeness, or clinical suitability of MedDRA terms generated or suggested by Safeterm. The tool is designed to assist qualified professionals and should not replace human judgment.
  10. TERMINATION - ClinBAY reserves the right to terminate or suspend your access in the event of breach of these terms or misuse of the service. Upon termination, you must discontinue all use of Safeterm and delete any retained content derived from the service.
  11. GOVERNING LAW - These terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of laws principles.

By accessing or using Safeterm, you acknowledge that you have read, understood, and agreed to these Terms of Use. ClinBAY Ltd reserves the right to amend these terms at any time, with changes taking effect upon publication on the Safeterm platform.
